These Terms of Service (“Terms”) govern access to and use of the shieldbate website and service (the “Service”). By using the Service, creating an account, or accepting related agreements in the dashboard, you agree to these Terms and our Privacy Policy.

1. The Service

shieldbate helps Chaturbate creators authorize shieldbate to (a) collect publicly listed archive URLs tied to a verified Chaturbate username and (b) submit DMCA takedown notices to enabled third-party hosts as the creator’s authorized agent. The Service does not host user-uploaded videos or operate an archive of creator recordings.

Host coverage may change. Recu.me is the initial enabled host. Filing outcomes depend on each host’s process; shieldbate does not guarantee that any URL will be removed.

2. Eligibility

You must be at least 18 years old and legally able to enter contracts. You must own or control the copyright (or have authority to act) for works associated with the Chaturbate username you verify. You may not use the Service to target another person’s username or content.

3. Accounts and verification

You are responsible for account credentials and for information you submit (including verification tips, notice contact details, and ownership claims). We may suspend or terminate access for false information, abusive filings, or other misuse.

4. Agency authorization

Before we file notices on your behalf, you must accept the DMCA Agency Authorization Agreement then in effect. Filing is limited to your verified username and hosts we enable. See also our Copyright page.

5. Payments and tips

Access may require tip verification and payment through Chaturbate as shown in your dashboard. Unless we state otherwise in writing, tip payments are non-refundable once matched, including if a host declines or ignores a notice. Prices and requirements may change; the dashboard controls the amount due for a given period.

6. Acceptable use

You agree not to:

Submit false ownership claims or inaccurate notice contact data
Authorize filings for content you do not have rights to enforce
Interfere with the Service, workers, or other users’ accounts
Use the Service for harassment, fraud, or unlawful purposes
Attempt to scrape, reverse engineer, or overload our systems

7. Intellectual property

shieldbate and its branding, software, and site content are owned by the operator or its licensors. These Terms do not transfer ownership of your copyrights to us; you only grant the limited agency rights described in the Agency Agreement and what is needed to operate the Service.

8. Third-party services

The Service depends on third parties (including Chaturbate, archive hosts, hosting, and authentication providers). We are not responsible for their availability, policies, or decisions.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted service, successful takedowns, or that collected listings are complete.

shieldbate is not a law firm and does not provide legal advice. These pages and in-product copy are operational terms, not counsel.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHIELDBATE AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING FROM THE SERVICE OR FILINGS. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO SHIELDBATE (VIA TIP MATCHING OR OTHERWISE) IN THE THREE MONTHS BEFORE THE CLAIM.

11. Indemnity

You will defend and indemnify shieldbate and its operators against claims, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Service, false or unauthorized DMCA claims, or breach of these Terms or the Agency Agreement.

12. Suspension and termination

We may suspend or end access immediately for breach, risk, or operational reasons. You may stop using the Service at any time. Provisions that by nature should survive (including disclaimers, liability limits, and indemnity) will survive termination.

13. Changes

We may update these Terms by posting a revised version with a new “Last updated” date. Continued use after posting constitutes acceptance, except where additional consent is required (for example, a new Agency Agreement version in the dashboard).

14. Governing law

The operator’s principal place of business is Spain. These Terms are governed by the laws of Spain, without regard to conflict-of-law rules, unless mandatory consumer protections in your country require otherwise. Courts in Spain have exclusive jurisdiction, subject to any mandatory venue rights you may have as a consumer.
